In light of recognizing the efforts put in by students taking the TOEFL iBT Test, ETS India Private Limited (“ETS India”) is rolling out a Star Performer – TOEFL iBT Test Award in India (“Award”) under which the students taking the test (“Participants“) shall stand a chance to win e-Vouchers of an amount worth up to INR 2000 (Indian Rupees Two Thousand Only) and receive an e-Certificate, subject to fulfilling the eligibility criteria mentioned hereunder.

Ensuing are the terms and conditions (“T&Cs”) that shall govern the giveaway of the Award:

1. For a Participant to be eligible for winning the e-Voucher, he/she shall:
   • Be a citizen and resident of India;
   • Have applied for tests to be taken at the TOEFL iBT Test Center only;
   • Register for the TOEFL iBT tests (“Tests”) anytime during the period starting from 1^st August 2023 until 30^th September 2023 only;
   • Have achieved a minimum score of at least 83 marks in the Tests and
   • Submit the following on the website of ETS India:
   • The Valid TOEFL test score report showcasing the marks obtained by him/her and
   • A recent color photograph of the test taker
2. For a Participant to be eligible to receive the e-certificate, he/she shall:
   • Be a citizen and resident of India.
   • Have submitted their entry for the Award on ETS India website only.
   • Have submitted to rewards@etsindia.org, a testimonial in the form of a video recording of less than 60 seconds (with clear audio and video quality) on or before 15^th Oct 2023.
   • Allow ETS India to the use the testimonial video for its marketing purposes on both its offline and online channels.
3. There shall be three categories for the giveaway of the e-Voucher and the same shall be basis the following:
   • Participants having a Test score above 115 shall be eligible for an e-Voucher of an amount worth INR 2000 (Indian Rupees Two Thousand Only);
   • Participants having a Test score ranging from 100 to 115 shall be eligible for an e-Voucher of an amount worth INR 1000 (Indian Rupees One Thousand Only);
   • Participants having a Test score ranging from 83 to 99 shall be eligible for an e-Voucher of an amount worth INR 500 (Indian Rupees Five Hundred Only).
4. There shall be 3 categories for the giveaway of the e-Certificate and the same shall be basis the following:
   • Participants having a Test score above 115 shall be eligible for a Gold e-Certificate;
   • Participants having a Test score ranging from 100 to 115 shall be eligible for a Silver e-Certificate;
   • Participants having a Test score ranging from 83 to 99 shall be eligible for a Bronze e-Certificate.
5. Each Participant shall only be eligible once to win an e-Voucher under the Award.
6. The Participants shall ensure while submitting their entries for the Award or while uploading the required details on the website of ETS India, that the same should not contain any software viruses or any other computer code, files or programs that may be designed to interrupt, destroy, or limit the functionality of any computer resource. In the event of any damage to the computer systems due to documents uploaded by the Participants, the Participants shall be liable to indemnify ETS India for losses and damages suffered.
7. The time and mode of distribution of the Award shall be decided by ETS India upon its sole discretion, subject to the T&Cs and the same shall be final and binding on the Participants.
8. The Participant hereby agrees that he/she shall not hold ETS India and/or its employees liable for delays or any technical problem in connection to the distribution, quality, or any other dispute that may arise in usage of the e-Voucher code.
9. The Participants of the Award shall, within 7 business days from the date of score validation, be informed about becoming the Awardees through the mode of email sent from rewards@etsindia.org, with his/her basic personal details.
10. Only such entries that are made by the Participants in accordance with these T&Cs shall be considered as valid entries for the Award. Once uploaded and published, Participants are not allowed to request for removal, editing or altering the entry/Reel in any manner whatsoever.
11. Failure to adhere to the T&Cs shall render a Participant to be immediately disqualified of participation in the giveaway and for winning the Award. ETS India hereby reserves its right to initiate legal proceedings against such person(s) which may include but not be limited to refund of the Award so won.
12. ETS India hereby reserves a right to initiate legal action against any Participant believed to have undertaken fraudulent activities or other activities harmful for the Award, the entry submission process or is found to be acting in violation of the Information Technology Act, 2000 (as amended) or any other applicable law or regulation.
13. ETS India, at its sole discretion may substitute the Award with other prizes that it deems fit, without prior notice to the Participant/Awardee.
14. The Award shall not be not transferable, assignable, or exchangeable for a cash equivalent.
15. No other person other than the Awardees selected thereof by ETS India shall have the right to claim the Award.
16. All taxes, levies, and duties due and owing under the applicable and statutory laws in connection with the Award, if any, and all other costs, including insurance, incidental costs, gifts, gratuities, and taxes, shall be the sole responsibility of the Awardee(s).
17. ETS India reserves its right to postpone, suspend, modify, or cancel the Award at any time without prior notice, for any reason, including but not limited to acts of God, force majeure, technical/network difficulties, or any other reasons beyond the control of ETS India’. In case where ETS India suspends or cancels the Award in the interim, all aspects of the Award shall be null and void and ETS India shall not be liable to compensate any Participant for any postponement or cancellation of this Award.
18. The participation in the Award by the Participants is deemed to be voluntary and any personal information provided by the Participant in relation thereto, if any, is deemed to be received with the consent of the Participant and the same shall not be considered as confidential and sensitive. ETS India, while ensuring compliance with the applicable data protection laws of India, shall be free to reproduce, use, disclose and distribute this information for internal business purposes.
19. The Awardee(s) hereby consent to ETS India’s right to use his/her name, voice or picture, or the content of his/her Award entry (collectively, the “Publicity Rights”). ETS India can allow to its agencies to exercise/exploit the Publicity Rights in conjunction with ETS India. ETS India shall also be free to use any ideas, concepts, know-how or techniques contained in the entries received for the Award for any purpose.
20. Participants shall not be allowed to request for the removal or alteration of any entry/testimonial video once the same has been uploaded on the channels of and published by ETS India.
21. The conduct of this Award shall not fall under the definition of “lottery” as defined under the Lotteries (Regulation) Act, 1998. However, the Award shall be void where prohibited by local/State laws. All relevant national and local laws apply.
22. All rights, title, and interest, including but not limited to the Intellectual Property Rights in any/all images/photographs/videos uploaded by ETS India on its offline and online channels shall vest with ETS India only.
23. ETS India shall in no manner whatsoever, be responsible and/or liable for any injury, death, mental trauma caused to any Participant for any reason in connection to the Award.
24. Any dispute or claim (contractual or non-contractual) arising out of, or in relation to this T&Cs shall be governed by and construed in accordance with the laws of India. Pursuant to the aforementioned, ETS India and the Participants hereby submit to the exclusive jurisdiction of courts at New Delhi.
25. The T&Cs as mentioned herein above shall constitute an agreement amongst ETS India and each of the Participants to the Award. Any Participant submitting an entry into the Award by uploading the required documents is deemed to have accepted the agreement and the T&Cs to be binding upon himself/herself (including legal heirs and successors).
26. ETS India hereby reserves the right to amend the T&Cs without prior notice to the Participant(s).
